Hello everyone
I have resolved some of the comments. After I have resolved

I need help in solving the other comments, because most of
them should be discussed. One person can’t just decide on them. Attached is a
document with the comments from Tobias. I have changed the colour of the
comments I have already resolved to gray. I copied the mailinglists just to keep them
up to date.
I think it would be a good idea to attach a document with notes when we send the documents to ChapCom (as Kerryn suggested).

I quickly browsed through the comments. I am happy to see
that Tobias answered the questions in good detail!
I have putted Tobias’ comments on a completely new page on
Meta: http://meta.wikimedia.org/wiki/Talk:Wikimedia_South_Africa/Tobias_comments
This way everyone could see the comments. We can now
implement each of the comments into the documents and then just move that individual
comment to the archive. This way things will start to clear up and then no one
could say we did things without their knowledge. When we are finished completely
with the documents we can create a PDF and send it to ChapCom.
I am going to start tonight already to sort the issues out. Let’s
see how this idea works.

As we're trying to *clean* up final docs, I wonder if we shouldn't just comment on Tobias's word doc where he has put his comments and suggestions ... ? Unless you're thinking of putting his comments onto meta and then responding there?
I'm not sure how we're going to clean up the documents as its getting pretty confusing with *seeing* what is what.
I think we will eventually have to take it off meta because we need to package - perhaps as a pdf - and send off to ChapCom?
... any suggestions ...

I have attached Tobias's responses to the queries and comments that were put onto meta with regards the Articles and Memorandum.
Please read through this answers; I think that they respond well to the queries. What we could do is put these on as Notes on the bottom of each page, on the hard copy, as they are not really for inclusion but are explanation for people such as Effeitsanders, when reading and approving these at ChapCom.
Please let me know if you are happy with them.
We will need to compile a package for sending to ChapCom, which in my mind should include the following:
Proposed articles of association
Memorandum of incorporationLong-term objectives
Short term objectivesAppointment of directors ? ( I haven't been keeping updated with this process so not sure where we are?)
Lourie and I have spoken briefly this morning and we suggested that perhaps we should have a final Skyp/gchat meeting and invite all the mailing list where we can discuss the putting together of the package, and other things and also when this package will go off to ChapCom.

Hi all,
I just spoke to a PR guy that I got introduced to, who gave me some
good pointers on setting up a press release around the 10 year
anniversary of Wikipedia. Among all the other good pointers that he
gave me, he recommended that we send it out on Tuesday to have the
best possible chance to get it into the papers for the 15th. I'll
have a draft ready by the end of Saturday at the latest, and then I'll
let you all know to check it out.

I can be wrong, but I think that the Stellenbosch celebration
is only going to be a party or as we would say in Afrikaans; a lekker
kuiertjie. The Ten Page mentions that it’s the evening at Aandklas (Old
School Rock Café), so I don’t think that would be appropriate for a seminar. What
do you guys think? I have copied the mailing list, because that way we might
get suggestions from the other subscribers.

David, I saw your message to the lists regarding Stellenbosch activity for the 10-year mark. A few days ago over the holidays I received an email from Achal which said that there was some money available if we wanted to do something small to celebrate the anniversary on 15 January. He suggested perhaps getting some people from ChapCom here to SA to speak at a seminar, and suggested the possiblity of Wits. However, if something is being done in Stellenbosch perhaps we should look at something in the Cape.
I have emailed Achal though because we will never be able to organise something for 15 and also most universities only open much later. So I asked him if we did something end January whether ChapCom would still think it worthwhile.
I'll get back to you as soon as I've heard from him again.

am my name is Arie Robert Scheurwater, but please call me Rob or Robert.
I have some questions for people and about other people's decisions that
have been made so far.
Below are the points that I will be addressing in this email:
1. Surnames on the website (www.wikimedia.org.za)
2. The responsibilities of a 'Board of Directors'
3. The legal structure of Section 21 companies

5. Difference between Reply To and Reply All buttons
1. Surnames on the website (www.wikimedia.org.za)
It would be a good idea if people put their surname on the Wikimedia ZA
website next to their name, because it will make it easier to reference
people in emails.
2. The responsibilities of a 'Board of Directors'
A lot of people in the 'community' currently wanting to become a 'director',
but understanding of the term 'director' is misunderstood:
- Your first responsibility of a 'director' is too giving legal
responsibility of the organization to the government.
- Your second responsibility is to make sure everyone is doing
their duty.
- Your third responsibility is to take up responsibility for other
people's mistakes.
People think that a director is a person that leads an organization which is
not true, because the person that leads the organization are all the members
together.
3. The legal structure of Section 21 companies
I know the legal structure has already been decided by Mr. Tobias (unknown
surname). Section 21 Companies are, and will always be the most difficult
and irratating legal structure to use when starting an organization. Section
21 Companies are intended for organization that have a bigger quanity of
members and higher cashflow e.g. Red Cross, St Johns Ambulance, Heart
Foundation of America, etc. The Section 21 Companies can be registered
according to two different acts: Companies Act 61/1973 or Co-operatives Act
91/1981 neither one if favourable for a starting organization. Most
organizations that are currently Section 21 Companies, started off as a
plain partnership NPO. Section 21 companies were created so that the
government could have more insight in the finances of the organization (we
have no finances at the moment). A plain NPO Partnership is the best
starting legal structure for an organization. Below is a hierarchy structure
for the organization that I would have advised at the time.
4. Wikimedia ZA not Wikimedia SA
I have noticed that a lot of people are calling the chapter and organization
Wikimedia SA which is an issuse that needs to get address, because SA means
Saudi Arabia not South Africa according ISO 3166 code standards. I do not
think we want people to misinterpret 'us' (the chapter and organization) as
Wikimedia Saudi Arabia.
P.S. if you do not know the ISO 3166 code standards I am sure the standards
will be on Wikipedia or you can always just Google them otherwise.
5. Difference between Reply To and Reply All buttons
People say time is money, its true., so please don't use reply to all if its
not nesserary to do so, because it wastes people's time.
In conclusion there are several things we as a community should seriously
take a look at. You can ask anyone that works for me or has partnered with
my company I view things with a more coporate risk angle instead of the
'lets try it' attitude. I am not saying my inturpretation is better, but it
has saved me a lot of legal problems and time.
