Suisuiさん、コメント感謝です。他の方もよろしくお願いします。 以下、お返事、改訂案など。 From: Sui Min To: Mailinglist of Japanese Wikipedia <wikija-l(a)Wikipedia.org> Sent: Sun, 4 Jul 2004 12:51:14 +0900 Subject: Re: [WikiJA-l] draft of the letter to the Foundation regarding copyright issues. これはまだそうと決まったわけではないので断言はしない方がいいかと思います。というか、 GFDLに明確に違反するならそれを導入することに仮に日本語版で合意が形成されるとしても、 かなり問題でしょう。僕も反対ですし、Suisuiさんもそうならないように反対して下さい。^^;)　 例えば、「ある時点以降に作成された記事についてはGFDLと少し違う条件で、履歴を保存する 代わりにリンクを張るなどだけでも構わない」というような形であれば、過去の投稿に 依存しないので、特にGFDL違反にはなりません。 ただ、GFDLに違反しないとしてもGFDL以外の許諾を導入するわけで、もしもSuisuiさんが聞いた ように財団がGFDLを非常に重視しているのであれば、そこははっきり伝える必要があると思います。 ウィキペディアのコンテンツをGFDL以外で利用できるようになっていてはいけない、というのが 財団の意向であれば（そういう意見は聞いたことはないですが）それは知っておく 必要があるでしょうし。 それについてはFirst, Second,　という2つの段落で、どういうことを検討しているのかの 例も含めて書きましたが、どうでしょうか。 ここにあるような話題は、英語版で昔からやっていることなので、何のことだかはよくわかる だろうと思います。 ただ、英語版では、GFDLを字義通りに守らなくてもそれはGFDL違反にはならない、 という方針でやっているのが日本語版とは大きく違いますが。あえて言えばその点を付け加える のがいいでしょうか。 Also, please note that Japanese Wikipedia does not take the position that "it is legally safe not to literally follow the terms of GFDL, if we follow them in spirit." The position is taken by English Wikipedians, based on American legal practice, but we also consider Japanese law and try to be more faithful to the letters of GFDL. This means that we cannot simply say "link back to the original article without preserving history is in compliance with GFDL in spirit, and therefore it is okay." If we want to allow such practice, it should be done a bit more formally, such as in a explicitly stated permission that all contributors agree. ちょっと長くなってしまいますが、こういう文があった方がいいでしょうかね。 "GFDL is among the core elements of the Foundation's projects" ぐらいがいいですかね。 "GFDL, along with MediaWiki software and NPOV policy, is the core element of the Foundation's projects" とか？ この単語いつも間違えます。^^;) Tomos
