To remove the check box, remove this line from SpecialUpload.php:
<input tabindex=3 type=checkbox name="wpUploadAffirm" value="1" 
id="wpUploadAffirm">
And you'll also need to remove the check for it in the form processing, 
in the same file:
    if ( 1 != $wpUploadAffirm ) {
    	mainUploadForm( WfMsg( "noaffirmation" ) );
    	return;
    }
