I thought that was probably intentional. A joke along the lines of it
never being a good idea to get involved in a court case, whatever side
you're on (unless you're the lawyer, of course).
The historic existence of submarine patents suggests otherwise. Mind
you people trying a similar tactic with software patents don't appear
to be doing to well.
