When a ND picture qualifies as fair use, the reason why you can maintain the
existence is that it is fair use. The fact that it is also available as a ND
is irrelevant and would be a reason for deletion.

And what about ND images? If there is an image that is fair use on a page,
and the rationale is strong enough to allow me to use it, then surely I
would be allowed to use an ND image at the same place.
