"Open" in their parlance does not mean "not encumbered by patents". Adobe also considers PDF an "open" standard despite significant parts that are patent-encumbered. In principle, patent-encumbered PDFs should not be allowed on Wikimedia (although we lack the technical ability to easily filter them at present).
Don't mistake marketing claims for reality.
This looks like MW can use flash 10 and its swf format. I asked Adobe about this question. I let you know what there answere is.
