I am ***certain*** we discussed this issue. And I am 200% certain I deleted the image. Yet, it is back up and I am again informed it is an orphaned-non free and it should be speedy deleted.
I do not get it... errr, a mad electron ?

If you want to maintain discussions it would be easier on everyone if you avoided top-posting.
There is more than one way to to interpret policy, and in a sane and sensitive world, one examines all mitigating circumstances. By your own admission your French is not good enough to have read whatever discussions may have taken place in that language on the subject. I believe that the picture in question has been discussed before, and sensible people brought it back. Even if it is a violation, not every violation needs to be prosecuted.

Well, it's CC-BY-ND, which isn't free by our standards, but use on their userpage wouldn't be infringement by the terms of the license.

en.wiki doesn't accept images that are permitted to be used only on Wikipedia, because our content has to be "free", "editable" etc. Then why would images that are permitted to be used only in userspace be tolerated?

You're right that enwiki doesn't allow it, but if another project wants to allow users to do that, it should be their choice, since it's not violating copyright law.

As I recall (and Anthere, apologies if I've got this wrong) - the image is a member of the fr community who died recently and Anthere wanted to keep it as a memorial, if it made sense. She was obviously prepared to let it go (and did, in fact, let it go) but someone applied IAR and *poof* it's back.

Yes. I'm just saying that if the user had been required to upload his self-portrait under a free license, we would not be having the post-mortem debate about whether or not we can use the picture for memorial purposes.

That's a stretch.. If anything should be implicit it should be compliance with the rules. In any event a fair use claim is unlikely for a resident of France.
