That's a stretch.. If anything should be implicit it should be
compliance with the rules. In any event a fair use claim is unlikely
for a resident of France.
I consider this frivolous
because the creator/uploader had prerogative to choose a more suitable
license, but apparently preferred not to.
Did anybody ask him? What alternatives were offered to him at the time?
