Caros,
a trabalhar!
importantes neste momento.
Delphine, I really believe you can understand written portuguese. If not, I may reply in
English as well.

Subject: Re: [wikimedia-pt] Wikimedia Italia sued + servidores + pedido à Delphine
Hello!
algum
conteúdo menos próprio!!!! (Ainda ontem estive a retirar conteúdo
The real question here is... why would WM PT need to have a copy of
the pt wikipedia? Is there a real reason for that? Would it be a live
copy? A static copy ? Open to the public ? Closed ?
Many questions which you need to ask yourselves before getting a
server from Florida to cross the Atlantic ;-)
I personally don't see any real reason why any chapter would need to
have copies of WP.
However, a server for your own website, your members, etc. Why not.
BUt I am not sure that it makes any kind of sense to ship a server
across the ocean (which probably costs a lot of money in shipping and
customs taxes etc.). Wikimedia France works for their own needs with a
sponsor we have found which hosts our websites and wikis. It should be
relatively easy to find in Portugal.
But now, i'm going to write in
English, in case some participant cannot read French (and my French isn't
what is used to be...) First, i want to thank your willingness to explain
how to plan and request our grants.
You' re welcome. :)
Second, and because you may not have
understood completely the latest issues, I want to ask your advice, taking
avantage of your experience in WMF chapters. The first issue was about the
possibility of our chapter being sued for the contents of the WP in
Portuguese, as happened with the Italian WP.
Frankly, yes. There is always a possibility. Every legal system is
different, so I can't say it's easier in Italy than it would be in
France or Portugal, but history shows that people who have a problem
with Wikipedia will always get to the most easily reachable
organisation.
There are ways to make sure that this happens as little as possible,
here are some tips:
- NEVER edit Wikipedia or any other projects in your capacity of
member of WM PT. Never ever. NEVER EVER. Nunca nunca. A chapter is an
association of users, it has absolutely no editing power on the
websites.
- If WM PT receives an informal complaint, it should always answer
"sorry, we can't do anything ourselves, but you can write to the bunch
of volunteers who work on Wikipedia and can help you" (then you
forward the email to OTRS-pt and make sure people take care of the
question if it's legitimate.
- If WM PT receives a formal complaint. If the complaint is issued by
a lawyer. ALWAYS ask for legal advice before answering anything in the
name of WM PT.
Depending on the nature of the complaint, answer that you're sorry,
but WM PT does not host the websites, and the complaint should be
formally addressed to the Foundation. Also involve trusted editors
(but not necessarily members of the chapter, and definitely not
members of the board) to help resolve the problem if necessary.
In doubt about what to do, there are a good numbers of other chapters
and people like me who can help you make (hopefully) the right
decision about something. Don't hesitate to ask. Better ask than make
a mistake.
All in all, I believe that there are risks for the chapter, but that
those risks are not too high. A lawsuit like the Italian lawsuit is
something that seems to be also inherent to the Italian legal system.
It does not happen every day. But we always need, as chapters, to be
prepared :)
In short, the first "sponsor" you want to have is a legal firm, who
will be willing to work for you pro-bono. ;-)
The second is about the
possibility of getting some of the old servers WMF is offering - could they
be a liability, in case someone wanting to sue us, in case we keep copies of
WP in Portuguese?
See my answer above. It depends what you want to do with copies of Wikipedia...
Cheers :)
Delphine
