It was not uploaded under a license compatible with the GFDL, so there must have been an implicit (though perhaps subtle) claim that of "fair use", even without a specific rationale.
That's a stretch.. If anything should be implicit it should be compliance with the rules. In any event a fair use claim is unlikely for a resident of France.
I consider this frivolous because the creator/uploader had prerogative to choose a more suitable license, but apparently preferred not to.
Did anybody ask him? What alternatives were offered to him at the time?
