IANAL, but I believe that you can't stop people from talking about you
by demanding they not use your trademarked name.
Given that O'Reilly already publishes a number of books that are also
available under free-content licenses, you might do better through
polite requests than legal threats. Depending on their sales curve,
opening it up at some point could well give them a nice sales boost.
