It was not uploaded under a license compatible with the GFDL, so there
must have been an implicit (though perhaps subtle) claim that of "fair
use", even without a specific rationale. I consider this frivolous
because the creator/uploader had prerogative to choose a more suitable
license, but apparently preferred not to.
