Maybe it's best if you don't answer, but would it be appropriate for the foundation, or any named individuals to make a comment to the effect of "Yes, a lawsuit has been filed" or "I have no knowledge of any actual filing"?

If there has been or is such a filing, wouldn't it be public knowledge anyway? It may be best if someone familiar with the Utah courts just finds out for themselves and lets us know rather than involving the Foundation.

Did he say a couple of months ago on this list that he was already doing so? He made similar threats repeatedly, I don't think anyone has received a summons yet.

If memory serves, I asked Jimbo on this list to explicitly say it was all nonsense and he did so. That's good enough for me. (That might have been over a different matter, I'll check the archives.)

Found it. Foundation-l, March 9 2008, in reference to Merkey's claims that in exchange for a donation he was put under Jimbo's protection (among other things), Jimbo said: "It's nonsense". (http://lists.wikimedia.org/pipermail/foundation-l/2008-March/039553.html)
Not purporting to speak for anyone else, but on a scale of 0 - 10, my terror and apprehension levels on this would have to look way, way up, to reach zero.
