There is no date that I can see on it. However, I just found the email address of the person who submitted the photo to the Find-a-Grave site. I don't know if he is the person who actually took the picture, or simply submitted it.

Well, try to contact him and ask him the folowing:
1. If he took the photo or has the rights to it 1. If no, does he know the person who does, or is it expired already? 2. Will he release the rights to it, or put it in a commons licence?

I don't think so, because he is most likely wrong. All photos are copyrighted unless the copyright owner specifically releases the photo into the public domain. If that had happened, I would have expected him to say so. More likely, the photo is used with permission, or is licensed under certain terms, in which case, we need more detail.

Ok, thanks. I also emailed the Find-a-Grave site itself but have not, as yet, received a response. I'll wait and also dig further to try and find the identity of the person who actually took the photo.

Photos on find-a-grave are, unless explicitly stated otherwise, going to be copyrighted by the contributors with all rights reserved. There are almost certainly copyright issues :-)

I believe that the copyright is still with the uploader to that website. It says the website doesn't assume copyright, but I don't think that means that the images are automatically in the public domain (see http://www.findagrave.com/disclaimer.html) --Mets501
