Hallo zusammen,
hier sind die neusten Infos vom Wikimedia-Vorstand (Foundation!).
Es geht um den Fundraiser an dem wir eigentlich teilnehmen wollten. Das
Fundraising Agreement wurde wie am 13. Juni auf dieser Liste angekündigt
unterschrieben.

Der Eingang wurde am 20. Juni von Moushira bestätigt.
Nun kam untestehender "Brief" bezüglich der ganzen Sache.
Wikimedia-Vereine ohne Steuerabsetzbarkeit sind nun ausgeschlossen
worden. Die Foundation sieht keinen Mehrwert darin, wenn diese Vereine
selber Spenden einsammeln sondern nur einen Mehraufwand (Overhead) da
mehrere Vereine die entsprechende Infrastruktur aufbauen und verwalten
müssen, Gelder transferiert werden müssen etc.
Ich persönlich bin sehr überrascht und natürlich enttäuscht. Mit
Hinblick auf unserer Beteiligung haben wir den Fundraising Summit
ausgerichtet, das Agreement verhandelt und unterzeichnet, Holger aus
Schweden eingeflogen um uns bei der Aufbau der entsprechenden
Infrastruktur zu helfen und viele Kleinigkeiten mehr die uns wir auf uns
genommen haben um den Fundraiser vorzubereiten.
Nun habe ich eben mit Barry Newstead dazu angesprochen. Er erklärte mir
den Grund für diese Entscheidung (s. oben) und sagte, dass es nur drei
Chapters gäbe, die das beträfe (Australien, Schweden, Portugal). Dass
wir betroffen sind wusste er offensichtlich gar nicht. Er wird nun mit
betreffenden Leuten und Moushira sprechend und dann wieder auf uns
zukommen, ich bin gespannt.
In Brittanien scheint es ähnliche Probleme zu geben, auf der
Internal-Mailingliste ist gerade ein wahrer Entrüstungssturm
losgebrochen wie die Foundation auf die Idee kommt erst Fundraising
Summit, Verhandlungen, sogar schon Banner- und Fundraisingtests
verstreichen zu lassen um dann diese fundamentalen Änderungen
vorzunehmen. Insbesondere dass die WMF dieses Jahr extra früher starten
und alles rechtzeitig fertig haben wollte.
Interessant wäre nun ein Statement von unserer Arbeitsgruppe die wir an
der Mitgliederversammlung dafür eingesetzt haben.

Ich denke, dass noch nicht das letzte Wort gesprochen ist. Wir haben
noch ein paar Optionen - vom Erreichen des Absetzbarkeitsstatus (eher
unwahrscheinlich, aber wir haben ein paar neue Ideen) über eigenes
Fundraising, Verhandlungen mit der Foundation bis hin zu Grants (wenn
alle Stricke reissen).
Darum bitte ich um besonnene Reaktionen, auch wenn die Nachricht doch
eher sehr schockierend / ärgerlich ist.

Wikimania, the Board approved sending the following letter regarding
concerns with our shared fundraising practice, and outlining principles
for future fundraising practices.

The Board of Trustees has recently reviewed our fundraising model and
issues related to the way donor funds are received. This review followed
detailed discussions among the Board's Audit Committee and with our
outside auditors, which highlighted issues about the level of financial
controls over donor funds that go directly to the chapters who act as
payment processors. This review focused on the model established last
year, under which donors in certain countries are exclusively directed
to the local chapter during the annual fundraiser. In our 2010-2011
year, about $4M net went directly to 12 chapters, representing roughly
15% of the total funds donated to the movement.
There are several problems with this model, and with the current
fundraising situation. Some chapters have received large sums of money
early in their organizational lives, before they have built the capacity
and financial controls to safeguard and best use those resources in
pursuit of the mission. Some chapters have received many times their
planned budget in a single fundraiser. Additionally, in some countries,
transferring funds internationally has been limited by regulatory
constraints.
There are also currently no movement-wide controls applied consistently
to all entities that receive donor funds. Some chapters, despite being
well-funded, have not reported in a timely way on their activities,
their financial status, and their use of donor funds, or have had
difficulties following the regulatory requirements of their countries.
This fundraising model has also contributed to significant resource
disparity among chapters. Some of the largest fundraising chapters have
revenue far greater than their stated need and capacity to spend, while
other chapters receive revenue only from Foundation grants or have
almost no revenue at all. The model also suggests that chapters are
entitled to funds proportional to the wealth of their regions, which
amplifies the gap between the Global North and South.
We need to improve our model to address these concerns and to improve
the distribution of donor funds across the Wikimedia movement.

==Design principles==*
Our design principles for improving the fundraising model are:
* We are deeply committed to decentralized pursuit of our mission and to
supporting the long-term sustainability of chapters and other movement
partners.
* Because of its role as operator of the websites, the Foundation has to
be satisfied that any organization directly receiving donor funds will
treat them with an appropriately high level of care and transparency.
* An organization can directly receive donor funds as a payment
processor if the following criteria are met:
** There is sufficient money raised in the geography to merit the
logistical effort.
** The organization offers tax deductibility or other incentives to
local donors.
** Regulatory issues about any international funds flows are fully resolved.
** The organization's current financial resources are not enough to fund
proposed program work.
** The Foundation can confidently assure donors to the chapter that
their donations will be safeguarded, that our movement's transparency
principles will be met, and that spending will be in line with our
mission and with the messages used to attract donors.
* The donation process should clearly disclose basic facts about the
organization receiving the donation.
* The Foundation is committed to a grants program to continue to provide
funds to those who can most effectively pursue our mission.
*==Next steps==*
These concerns need to be substantially addressed prior to the start of
the 2011 fundraiser. In particular, we expect all parties to live up to
current fundraising agreements including full compliance with all
reporting deadlines.
We appreciate that some chapters have already started working on their
budgets assuming that they would participate as payment processors in
the 2011 fundraiser, but may not be able to meet the new criteria
outlined above. The Foundation will work with these chapters to follow
through on the principles of the current Fundraising Agreement to
provide the necessary funds to continue their programmatic work and to
meet their operational needs.
The Foundation will significantly expand its grants program, and should
work closely with the Audit Committee to continue improving the controls
and disclosures around grants.

Hallo Manuel,
nene - so leicht bin ich eh nicht zu beeindrucken ;). Ich habe aber auch mal wieder fest gestellt, daß ich nur bedingt alle nötigen Informationen habe, da bist du und ist auch Kurt weiter. Auch wenn ich inhaltlich weiter zu dem stehe, was ich schrieb, ist es sicher nicht sinnvoll, hier noch weiter in der Form zu meckern.
Ich würde den Weg unterstützen, sich von der Foundation zu emanzipieren. Zudem würde ich empfehlen, in vielen Dingen eine enge Zusammenarbeit mit WMDE aufzunehmen. Synergien nutzen predige ich ja schon länger. Was WMDE zahlen kann, muß WMAT nicht zahlen. Aber das menschliche Know-how hat weder die Foundation noch WMDE für Österreich. Es wäre fatal, wenn das was aufgebaut wurde wegen der Kurzsichtigkeit der Foundation einbricht.
Ich bin über das Verhalten ernsthaft erbost, mir ist aber klar, daß Sue Gardner von ein paar Protesten nicht von ohrem Weg abbringen läßt. Enttäuscht bin ich aber auch vom Board. Offenbar haben wir doch die Falschen gewählt. Und auch die Chapter haben nicht die Richtigen Leute geschickt, wenn diese so etwas absegnen. Was es auf keinen Fall geben kann ist eine Diktatur der Foundation. Mir ist unbegreiflich, ob denen klar ist, was sie da machen. Frau Gardner sicher nicht, die hat die Wikip/media-Bewegung nie verstanden. Die ist Managerin und meint allen ernstes mit den Methoden, mit dem man ein Wirtschaftunternehmen leitet diese Bewegung leiten zu können.
Vielleicht sollte es damit beginnen, daß die Chapter ihre Zusammenarbeit mit der Foundation erst einmal einstellen. Vor allem die Zuarbeiten sein läßt. Wie soll denn der Griff in den "Global South" oder die Verbereitung des Autoren-Stammes zu mehr Frauen funktionieren, wenn nicht die Chapter die Basis-Arbeit machen? Die Chapter sind keine Bittsteller. Auch wenn Frau Gardner und das Board das offenbar so sehen.
Ich schaffe es nicht wirklich meine Empörung über diese Vorgänge zu überwinden.

in der schweiz glauben wir derzeit noch dass es ein unglücklicher
ausrutscher der wmf war und reden auch mit leuten aus dem wmf stiftungsrat.
auch eine stärkere zusammenarbeit der chapter wird von vielen leuten hier
sehr positiv gesehen.
die alternative, richard stallman zu fragen, ob http://gnupedia.org oder
eine ähliche domäne nicht die deutsche, französische und spanische wikipedia
hosten möchte und die wmf mit der amerikanischen wikipedia allein zu lassen
geht zwar auch ... scheint aber schon sehr kriegerisch.

demnach wäre auch die lösung einfach: die verbesserung der ausgabenseite
soll diskutiert werden. wo die wmf nicht zufrieden ist soll sie
professionelle grant requests an chapters schreiben.

Ich antworte hier jetzt nur kurz und zu den Dingen, mit denen ich zu tun habe.
Im Gegensatz zu den meisten anderen Chapter liefert WMAT zumindest seit Januar 2011 monatlich Berichte ab, diese wurden auch sowohl von WMF als auch anderen Chaptern gelobt. Diesen Punkt musst Du zurücknehmen, auch wenn Du sie gerne ignorieren würdest weil Du kein Englisch sprichst.
Die Buchhaltung war ein Problem welches wir durch die Einführung von CiviCRM zumindest entschärft, vielleicht sogar gänzlich gelöst haben. Das betraf aber lediglich das Reporting an die Foundation bzgl. der Spenden. Unsere Ausgaben wurden / sind natürlich samt Belege dokumentiert. Dass wir mit der Zahl der Spenden ein Buchhaltungsproblem haben wurde bereits an der GV vorgetragen, die Mitgliederversammlung - allen voran Du - haben es aber abgelehnt hier den Vorstand durch eine temporäre Buchhaltungskraft zu unterstützen.
Der Voranschlag auf den aufbauend Beppo et. al. am Wochenende den Porgram Plan bzw. den Voranschlag 2012 erstellt haben stammt aus Februar und war ursprünglich für 2011 formuliert. Wegen vieler neuer Projekte die erst danach ins Leben gerufen wurden wurde der ursprünglich recht grobe Plan ständig revidiert.
Das wars, ich steig jetzt in den Flieger nach Schweden und melde mich voraussichtlich erst morgen wieder.

Frage an den Verein:
Im Gegensatz zu manch anderen Ländern /Chaptern, vermisste ich die
monatlichen Berichte an die Foundation.
So wie ich zB auch Antworten vermisse, die schon vor Monaten gestellt
wurden. Oder Antwort auf die Frage, was jetzt mit der Zusage von Bannern
für die Projekte mit dem BDA ist? Diese Frage wurde vor mehr als einem
Monat an Beppo gestellt. Antwort? Nada.
Was ist damit? Und wenn man liest, dass die Buchhaltung - die laufend
stattfinden muss, das ist eine zwingende, gesetzliche Vorgabe - im
August zusammengeschustert wird (so wie voriges Jahr, als die
Buchhaltung auch 18 Monate nach Beginn des Vereinsjahres erst begonnen
wurde), dann wundert es mich aber nicht, dass hier offenbar die Sache
durchaus eine gerechtfertigte Notbremse der Foundation ist. Da helfen
auch keine Schneiderschen Eigendarstellungseuphemismen.
Die Foundation ist halt so freundlich, und nennt die Chapter nicht beim
Namen, denen offenbar das Vertrauen entzogen wird. Dann macht man das
gleich generell.
Bei der MV gab es einen Antrag, einen Budgetplan für 2010/2011
vorzulegen. Wird dieser erst jetzt aufgestellt. Ein Budgetplan oder eine
ordentliche Abrechnung von 2009/2010 wurde auch nicht vorgelegt. Das,
was angeblich die Wirtschaftstreuhänderkanzlei geprüft hat, ist nicht
wert, Rechnungsprüfung genannt zu werden.

In allen Ehren, aber das ist kein "grossdeutsches" Problem. Da geht es nicht um DE vs. AT und CH und auch nicht um irgendwelche Kleinigkeiten, die in den Projekten passieren. Das machen nämlich die Autoren unter sich aus.
Hier geht es ums knallharte Geschäft, um den Umgang einer internationalen Stiftung mit seinen 35 Unterorganisationen. WMAT und WMCH stehen im Gegensatz zu Indonesien, Portugal, Mexiko und Chile nämlich ganz gut da. Kenya hat zwar auch kein Geld, ist aber noch gar nicht soweit als dass sie diese ganzen änderungen als Verein mitbekommen würden.

Dass es nur Deutschland bekommt, ist bezeichnend, denn Österreich und
die Schweiz werden in der Tat nicht wahrgenommen.
Dazu kommt noch, dass es einige Leute gibt in der Foundation, welche
Deutsche sind, aber was interessiert die, was die Fehlsprecher in
Österr. und Schweiz wollen?
Der nächste Akt wird sein, dass die deutsche Rechtschreibung durchgehend
auc in der Schweiz eingeführt wird (kein Sonderweg mehrmit dem ss, wozu
gibts ein ß, und in Österreich wird der Jänner abgeschafft!

Nur erklär mir mal was zu tun ist?
Wir können uns jetzt auf die Hinterbeine stellen, meckern, jammern und rumschreien - das passierte ca. zwei Wochen lang auf internal-l mit dem Ergebnis, dass die Betroffenen da ziemlich unter sich waren nachdem von WMF-Seite zwei drei Klarstellungen kamen die die Sache nicht besser, sondern schlimmer gemacht haben.
Dann das Argument "wem gehört das Geld denn"? Meiner Meinung nach den Autoren, also noch nicht einmal den Chaptern.
Die selbe Frage wurde auf internal-l auch diskutiert und Jimmy himself stellte klar: Die Projekte, das Geld, das gehört der WMF, schliesslich ist sie die Inhaberin und betreibt die Projekte.
Ich bin offen für Argumente und Ideen. Zufrieden bin ich mit der Situation nicht. Ich versuche aber zwei Sachen zu unterscheiden:
1) Finanzierung / Weiterführung des Vereins: da muss ich auf Kompromisse setzen. Würde mich wundern wer damit einverstanden wäre, wenn ich mich zwar lautstark auflehnen würde, aber damit die Finanzierung des Vereins abschneiden würde.
Aus dieser rein geschäftlichen Sicht muss man auch mit den Grants zufrieden sein: immerhin bekommen wir das selbe Geld für weniger Aufwand.
2) Verhalten der WMF / Vertrauen: hier hat sich die WMF wie Du sagst meilenweit von der Basis entfernt. Es ist sinnvoll die Frage zu stellen was denn als nächstes kommt - können wir uns nach diesen Erfahrungen denn überhaupt noch drauf verlassen, dass wir unsere Grants in Zukunft auch bekommen? Oder dass es sie in den kommenden Jahren noch gibt? Oder welche weiteren Einschränkungen der WMF zukünftig noch einfallen werden?
Es wird auch diskutiert inwiefern es nicht nur einen "disconnect" zwischen WMF und Chapter sowie Basis gibt, sondern wie nah dran die Vereine selber noch am gemeinen Wikipedianer sind. Welches Recht haben wir als Wikimedia österreich etwas gegenüber der WMF zu erstreiten, was viel eher den Autoren, "der Bewegung" oder "der Basis" gehört?
Ich bin gerne bereit mich dafür einzusetzen dass WMAT als Verein die Rechte der Gemeinschaft wahrnimmt. Das geht aber nur mit Rückendeckung bzw. moralischer Unterstützung der Autoren. Und dieser Beistand muss stark genug sein im schlimmsten Fall zu akzeptieren, dass wir als Verein vielleicht dabei unsere Haupteinnahmequelle zwischenzeitlich verlieren.
Auf internationaler Ebene diskutieren wir gerade auf der Chaptersmailingliste die ich im Auftrag von WMCH hoste. Dort sind nur Chaptervertreter unter sich, niemand von der WMF. Wir versuchen ein "Chapter Council" zu gründen, eine Art Interessensvertretung zwischen Chapter und Foundation. Da gibt es aber noch viele Fragen zu klären, bspw. ob das ein gewähltes Konsortium sein soll oder ob alle Chapter dort vertreten sein sollen (UN-Modell), ob es Angestellte braucht weil evtl. nur diese auf Augenhöhe und mit dem nötigen Zeitaufwand mit WMF-Angestellten verhandeln können.

Hallo zusammen,
Neues bezüglichen Spendensammelaktion.
Wie ich nun von meinen schweizer Kollegen mitbekommen habe, hat die
Wikimedia Foundation den Vorstandbeschluss noch verschärft:
Es darf nun _gar_kein_ Wikimedia-Verein teilnehmen, ausser Wikimedia
Deutschland.
Dh. auch die Schweizer, die die vom WMF Board geforderte
Spendenabsetzbarkeit besitzen wurden ausgeschlossen.
Holger von Wikimedia Schweden erzählt mir, dass die Äusserungen der WMF
auch unmissverständlich waren, dass sie das bereits geschlossene
Fundraising Agreement nicht interessiert, sie (die WMF) hätten es nicht
unterschrieben.
Wie dem auch sei, lamentieren hilft nichts, es wird weiter verhandelt.
Die Lösung mit den Grants statt Spendensammeln haben wir bereits in
Haifa diskutiert und unsere Vorstellungen Barry als Hausaufgaben
mitgegeben. Diese hat er nun gemacht und uns untenstehend einen Entwurf
für ein "Grant Agreement" zugesandt.
Ich habe es ins Mitgliederwiki geladen und kommentiert:

Unser "Program Plan" bzw. Voranschlag 2012 ist in der Zielgeraden, Kurt,
Christoph, Beppo und Reiner sassen das ganze Wochenende in Wien zusammen
und haben die Buchhaltung überarbeitet und den Voranschlag erstellt.
Beppo ist derzeit damit beschäftigt die einzelnen Posten auf deutsch und
englisch auszuformulieren.
Damit wäre er rechtzeitig vor dem 1. September fertig obwohl die
Deadline bereits auf 1. Oktober verschoben wurde. Wir werden ihn
natürlich vorab Euch zur Verfügung stellen (in den nächsten Tagen).

As promised, here is the draft grant agreement for your review. I hope
that the substantial points that we discussed are in here.
You will notice that there is quite a bit of legal language in there.
Don't let that overwhelm you. ;) The language is there mostly to ensure
that we a) ensure that it is clear that our organizations are
independent to protect you from legal challenges relating to content on
the projects; b) don't get in trouble with US or other country's laws
relating to international grants; c) so that we actually have an
agreement that, in the very remote chance that things go wrong on either
end or with a third party, we have a solid document to go to a court
with. That being said, I'm going to work with Geoff Brigham next week to
see if there are areas that can be simplified.
One issue that WM-Australia raised on our call is the idea of making the
grant renewable, so that we don't have to start fresh next year again.
I think it is a good idea and will try to work on something that
provides greater medium term stability.
Happy to have your feedback on the agreement before we finalize.
