Otherwise, these images are licensed with CC-BY-NC-ND license, which is not allowed on Commons.

YOU ARE REMINDED TO CONDUCT AN INDEPENDENT ANALYSIS OF APPLICABLE LAW BEFORE PROCEEDING WITH A PARTICULAR NEW USE"
I think it depends on the image. For example, we can declare http://www.flickr.com/photos/brooklyn_museum/2488876755/ to be PD-US (pre-1923).

Since I'm trying to find a solution for Flinfo (http://commons.wikimedia.org/wiki/User:Flominator/Flinfo) which cannot choose things based on the picture. I think I will stick to PD-because with "Brooklyn Museum tagged it as no known copyright restrictions on Flickr". Any objections?

Thanks for arging me into the right direction. I've just created {{PD-Flickr-Brooklyn-Museum}} which will be added by Flinfo from now on. Feel free to improve it. I also changed the existing images to that template.

I missed part of the discussion, but PD-XYZ tags should only be used if XYZ is the author. We don't want any PD-NARA disasters again.

You will in that case want a separate non copyright tag. For example most {{PD-NARA}} tags should be replaced by {{PD-US}}{{NARA-image}}
