Hi all,
I do agree with Julia here. While we should keep our eyes on the prize
(digitisation, FoP) we need to start seriously looking at the liabilities.
It is not very obvious that the political cabinets of the Commission regard
this a realpolitik deal. A few more exceptions and return the industry will
get enforcement. Linking and platform liability are the two things that
worry me. We must be vigilant.
In this regard I'd like to remind of you the Platforms Consultation:

Don't be discouraged by the controversies, public
opinion and the
majorities in parliament are on your side. The pro FoP amendment just
wasn't adopted in plenary because it came too late in the day and couldn't
be fine-tuned in negotiations. I'm convinced that at least making the
exception mandatory and a minimum standard for what a FoP exception needs
to cover would get a majority.
If I were you, I would be more worried about the idea to extend the scope
of the communication/making available right to include linking, just so
press publishers can charge Google for news aggregation. This could very
well affect Wikipedia links to newspaper articles as well (aside from the
fact that it would break the Internet...)
Best,
Julia

That is interesting! I'm surprised that the Commission has the guts to
float
such proposal after the controversies we saw at the EP vote.

You might find it interesting that the "panorama" exception (their
words) has been used to highlight issues with cross border exchange of
content. (Section 3)
