I do agree with Julia here. While we should keep our eyes on the prize (digitisation, FoP) we need to start seriously looking at the liabilities.

It is not very obvious that the political cabinets of the Commission regard this a realpolitik deal. A few more exceptions and return the industry will get enforcement. Linking and platform liability are the two things that worry me. We must be vigilant.

Don't be discouraged by the controversies, public opinion and the majorities in parliament are on your side. The pro FoP amendment just wasn't adopted in plenary because it came too late in the day and couldn't be fine-tuned in negotiations. I'm convinced that at least making the exception mandatory and a minimum standard for what a FoP exception needs to cover would get a majority.

If I were you, I would be more worried about the idea to extend the scope of the communication/making available right to include linking, just so press publishers can charge Google for news aggregation. This could very well affect Wikipedia links to newspaper articles as well (aside from the fact that it would break the Internet...)
