For example, http://commons.wikimedia.org/wiki/File:Turner,_J._M._W._-_The_Fighting_T%C3%... in the public domain.

MediaWiki doesn't keep track of a file's license. License information on Commons is displayed using templates, but those only have meaning to the humans that see them not to the software.
So I guess the answer to your question is: you don't.

Or you can look at the categories on the page to about the same effect.
