he claims zero people have been sued for using buildings in their photos on facebook. Is this actually the case? It would be nice to reply if people have actually been approached by a right holder that their holiday picture on facebook was not allowed (under french/italian etc law). I almost cant imagine this never happened (although I guess nobody would let something silly like that get to court...) Lodewijk

I don't think so and this actually makes a whole problem worse.
Because copyright started to concern everybody (i.e. everybody posessing an Internet-connected device is both an author, published and a user of copyrighted works), it is also equally and generally ignored. The copyright law is ignored, UNLESS you step on somebody's toe, especially if that somebody is important.
So we create an immoral situation, where the law is generally ignored (also because of lack of knowledge) but it sits somewhere in the corner like a gun that can be anytime used against you.
Some police units search computers routinely for unlicensed software - it's easier than other works, since usually some fair use provisions do not apply; and if something is found a pressure is created against the person owning the equipment, especially in case of smaller/petty crimes or misdemeanors.
So basically those few Big Artists are creating a chilling effect on everybody; regardless of what I think about Facebook terms of use or about Web 2.0 abuse of Internet users' rights I object to criminalize millions of people because of some vested interests. Holiday photos are mostly irrelevant.

Yes, I got the point with the zero people being sued. What is also interesting is him comparing Wikipedia to some "american monopoly". Yes, Americans wrote also French Wikipedia, thanks to their education system giving them an excellent French knowledge :-D (just joking, but it is hard to reason with such a bull****)... The reason why I asked for a translation is to get some nunaces from his press release. If the right for licensing building photos stays with the copyright owner, Cavada has no way of guaranteeing some will not start doing it (or sell the rights to do it) as a side income. The alternative is to create a collection society which is the sole organization permitted to pursue copyright violations (that's how fees are collected for e.g. playing music in your store in many countries); in which case the upkeep costs of that society have to be collected at the very least, so again they will have to sue someone or otherwise make them pay.
