As far as Wikipedia is concerned, some members of the Filipino editors'
community (myself included) are trying to gather a consensus before
requesting for a blackout of the English Wikipedia for the Philippines
(that is, a 24-hour blackout that will only take effect here and not
including other countries). We might probably include other local
Philippine-language Wikipedias as well, but that's still under discussion,
here:

I have only been able to participate in soliciting the input of other Pinoy
WIkipedians (through messages in their Talk pages) just now, as I was away
from my desktop computers recently. So I'm not sure how many other Filipino
Wikipedians are yet to hear of our proposal. (This proposal, by the way, is
an initiative of the local editing community and is not an official action
of the local chapter, Wikimedia Philippines.)
Outside Wikipedia, however, the rage against the bill is pretty s trong. A
lot of Filipinos have changes their Facebook and Twitter profile pictures
into a solid black square. Even a news website

its layout to a black background. There was a protest movement yesterday at
the Supreme Court, in support of the seven (7) petitions asking for a
temporary restraining order (TRO) of Republic Act 10175; however, no TRO
was issued yesterday as a number of judges were absent because of official
duties. Suffice it to say that, yes, there is a significant opposition to
the Cybercrime Law (specifically on the provisions on libel), and for sure
it will be in the news in the days to come....

Facebook, Google, Amazon join forces in D.C. lobby

Internet titans Facebook, Google, Amazon and Yahoo on Wednesday will launch
a new lobbying association to counter efforts by federal regulators to
strap new rules

The Internet Association, led by Capitol Hill veteran Michael Beckerman,
aims to band together Silicon Valley's biggest Internet firms on issues
such as piracy and copyright,

The lobbying shop, with four staff members and plans to hire more, has 14
members that include IAC, LinkedIn and Zynga. Absent from the roster are
Microsoft and Apple — rivals to Google, in particular, in mobile software
and advertising.
The trade association, the first for the Web industry, was created in
response to last year’s successful fight against anti-piracy legislation
that the firms feared would block or punish their sites for containing
pirated movies, books and songs. The bills, known as the Stop Online Piracy
Act

Protect IP Act, were derailed after online protests. The bills, supported
by some authors and Hollywood, are expected to be revived as Congress

Commerce Committee.
The lobbying group comes as Silicon Valley giants bolster their lobbying
budgets and expand offices in Washington.

already spent nearly $9 million on lobbying in the first two quarters
of 2012, compared to $3.5 million during the comparable period last year.

today, the EU parliament has approved a new directive on certain
permitted uses of orphan works:

Unfortunately, open-content platforms like WP don't belong to the
defined circle of entities which will be granted the right to digitize
and make accessible orphan works. Also, the scope of the directive
aims to non-commercial use only.
WMDE is currently taking part in the consultation process concerning
the implementation of the orphan works directive into national law.
Attached, you will find our statement given to the German Federal
Ministry of Justice in August (translated into English). Maybe it can
be useful for other purposes, especially within European chapters.
Please note that the letter referes to the provisional agreement:

Changes in the final version affect the matter of financial

The U.S government dismissed its case against Spanish website Rojadirecta
on Wednesday, handing a victory to critics of a controversial government
effort to crack down on piracy.
The Justice Department and Immigrations and Custom Enforcement (ICE) seized
two of Rojadirecta's domain names--rojadirecta.com and rojadirecta.org--a
few days before the Super Bowl in 2011. Authorities accused Rojadirecta of
copyright infringement because the site featured a set of links that
directed people to other sites on the Web where they could watch pirated
broadcasts of professional sporting events.
Puerto 80, the Spanish company that runs Rojadirecta, enlisted the help of
San Francisco-based law firm Durie Tangri to challenge the government's
seizure and fight for the return of its domain names, or Web addresses.
Attorneys for Puerto 80 had argued that simply linking to other sites that
might offer pirated content is not copyright infringement.
"We are pleased that the government decided to end this proceeding and
return our client's property," said Joe Gratz, a partner at Durie Tangri.
"[They have] been deprived of these domain names for 20 months now and had
to engage counsel and fight about this for some time."
Internet advocacy groups, along with Sen. Ron Wyden (D-Ore.) and Rep. Zoe
Lofgren (D-Calif.), had criticized the seizure, noting that Spanish courts
had previously exonerated Rojadirecta of copyright infringement. They also
argued that Rojadirecta was complying with the copyright laws in the
country it was operating out of.
The seizure was part of the joint "Operation in our Sites" effort led by
Justice and ICE to clamp down on piracy and the rise of websites that
illegally offer copyrighted movies, music and other content. Critics had
claimed this operation threatened free speech on the Web and lacked due
process. They also argued that it would put the United States in hot water
with other countries for shutting down websites that are operating legally
within their borders.
"From our point of view the flaw is as it always has been: Linking to sites
on the Internet isn't copyright infringement," Gratz said. "The same way
the Yellow Pages isn't liable if someone listed in the Yellow Pages is
doing something wrong, a website that's linking to other sites ... isn't
liable."
Preet Bharara, the U.S. attorney for the Southern District of New York,
submitted the notice of voluntary dismissal on Wednesday. In a letter to
U.S. District Judge Paul Crotty, the federal prosecutor didn't shed much
light on the reasoning behind the decision to return Rojadirecta's domain
names.
"The government respectfully submits this letter to advise the court that
as a result of certain recent judicial authority involving issues germane
to the above-captioned action, and in light of the particular circumstances
of this litigation, the government now seeks to dismiss its amended
forfeiture complaint," Bharara wrote. "The decision to seek dismissal of
this case will best promote judicial economy and serve the interests of
justice."
Advocacy group Public Knowledge, an opponent of the government's seizure
operation, cheered the government's decision to dismiss the case.
"It is far too easy for the government to seize domain names and hold them
for an extended period even when it is unable to make a sustainable case of
infringement," said Sherwin Siy, vice president of legal affairs at Public
Knowledge. "The constant expansion of copyright enforcement laws has given
us a system where website owners are effectively treated as guilty until
proven innocent. These sorts of abuses are likely to continue until there
are adequate safeguards to assure accountability."

These lofty goals are admirable, and we absolutely share them," said David
Segal, executive director of Demand Progress. "But it's critical that the
Dems make sure that the platform language -- and their actions in office --
live up to this rhetoric."
