I asked the Max Planck society about the copyright status of the document, and they replied that they are likely going to put it under CC BY, though this will take a while, as they will have to work through lots of red tape for that.

Regarding "no links": That is easily solved, specially if you are uploading OA materials, then just link from your OA main page to the declaration as a related document.
