Illegal suggests that there is a specific provision making such an act
against the law. If the matter is not mentioned in the statute, one
cannot fairly draw the conclusion that is illegal. Of course the Berne
Treaty provision would be law in any country that has ratified the
Treaty. Whether you call it "fair use", "fair dealing", or "fair
practice" the word "fair" is the constant theme in those expressions.
