I don't know.
I find the whole "its free but its not free" debate in photographs,  entirely 
pointlessly [[WP:POINT]] pointy.
 
It doesn't help our project to be legalistic about what pictures we can and  
cannot use internally.
 
If some photographer has an issue with our use, *they* should be the one to  
come and point it out and we'd remove the use.  Internal cat-fights over  
this, based on microscopic views of the terms is really distracting.
 
That's my opinion of the matter.
