Sounds like some kind of a reverse class-action process.  Rather than 
refunding the $5, it would be more in the spirit of free knowledge to 
put that money in a "fair-use defence fund" to beat back spurious 
allegations of copyvio.  Let the fair-use claimants put their money 
where their mouths are.
