I agree this is a good example.  Most all the cases I
have seen are not any of a release under CC-by-ND, but
more in the line of a notice stating "the copyright
holder permits distribution of this document without
modifications so long as this notice remains intact." 
Wikisource does not often deal with documents from
places which are involved with the "free culture"
movement.  So we have next to nothing that is released
under Creative Commons or GFDL besides the work of our
editors.  But I will try to compile a list of conrete
works that this disscussion involves soon.
