There is more than one way to to interpret policy, and in a sane and 
sensitive world, one examines all mitigating circumstances.  By your own 
admission your French is not good enough to have read whatever 
discussions may have taken place in that language on the subject.  I 
believe that the picture in question has been discussed before, and 
sensible people brought it back.  Even if it is a violation, not every 
violation needs to be prosecuted.
