It doesn't sound like he's whining,  just that he would prefer mediation 
where a consensus position could be worked out.  If one side refuses 
mediation it's not a matter of luck but of evidence that one side 
refuses to co-operate.  No need for you to get into dumb-ass accusations 
about spamming and whining.
