Last I checked, WMF is based in the United States, where they do apply. ;)

Really it's a matter of legal issues -- if WMF can confirm that it's not
going to be a problem to encode files to FLV as well as to Theora, then
there's no practical impediment to providing both formats.

It then comes down to the ideological question of whether we want to
provide it as well, and frankly I have no interest in arguing such a
question at this point. :P
