There is no single trademark law which allows a trademark to apply in every jurisdiction, so no, this is not necessarily valid worldwide. However, there is some protection via WTO/GATT. Furthermore, and I don't know if this has been initiated yet, it's possible to gain multiple marks using the Madrid system <http://en.wikipedia.org/wiki/Madrid_system> - basically filing for a bundle of trademarks for all participating countries.

Will the Foundation take legal action? Yes. That is, where there is an infringement the Foundation will begin the legal steps to address the issue. Whether that means taking companies to court or not would depend on the exact situation. (Unfortunately, I don't know enough about trademark law to give advice about what is or is not a mark infringement.)
