In the case of a photograph taken, or a painting or
portrait drawn, or an engraving or a cinematograph film made, for
valuable consideration at the instance of any person, such person shall,
in the absence of any agreement to the contrary, be the first owner of
the copyright therein.

നമ്മള്‍ ഒരു വ്യക്തിയുമായി സംസാരിക്കുന്നത് റെക്കോര്‍ഡ് ചെയ്താല്‍ അതിന്റെ കോപ്പിറൈറ്റ് ആര്‍ക്കാണ്? അവനവന് പറയുന്നതിന്റെ പകര്‍പ്പവകാശം അവനവന് മാത്രമാണോ?പറയുന്നതല്ല ക്രിയേറ്റീവ് വര്‍ക്ക്. പണിപ്പെട്ട് റെക്കോഡ് ചെയ്യുന്നതാണ്. (ചില കേസുകളില്‍ ഇത് വ്യത്യാസപ്പെടുന്നുണ്ട്)
അതുകൊണ്ട് റെക്കോഡിംഗിന്റെ ഫസ്റ്റ് ഓണര്‍ റെക്കോഡ് ചെയ്ത ആള്‍ തന്നെയാണ്.

ആരുടെയെങ്കിലും ആവശ്യപ്രകാരം, അയാളില്‍ നിന്ന് മൂല്യവത്തായ പ്രതിഫലം പറ്റിക്കൊണ്ട് ഒരു ഫോട്ടോ എടുക്കുകയോ, ചിത്രംവരയ്കുകയോ, പെയിന്റിംഗ് ചെയ്യുകയോ, കൊത്തുപണികള്‍ ചെയ്യുകയോ, (വരഞ്ഞെടുക്കുകയോ) സിനിമാഫിലിം നിര്‍മ്മിക്കുകയോ,ചെയ്യുന്നപക്ഷം, വിരുദ്ധമായ മറ്റുവ്യവസ്ഥകളൊന്നുമില്ലെങ്കില്‍ അയാള്‍ തന്നെ ആയിരിക്കും അതിന്റെ ആദ്യ ഉടമസ്ഥന്‍.
ആരെങ്കിലും കാശുമുടക്കി ഫോട്ടോ എടുത്താല്‍/എടുപ്പിച്ചാല്‍ ഫോട്ടോയുടെ അവകാശം അല്ലെങ്കില്‍ പകര്‍പ്പവകാശം, കാശുമുടക്കിയവന് അഥവാ നിര്‍മ്മാതാവിന് ആണെന്ന് മലയാളം !!
