I'm happy to announce that we are re-licensing the Wikimedia logos on Commons to CC BY-SA 3.0: https://blog.wikimedia.org/2014/10/24/wikimedia-logos-have-been-freed/
I would really appreciate your help with replacing the {{Copyright by Wikimedia}} https://commons.wikimedia.org/wiki/Template:Copyright_by_Wikimedia[1] templates on the logos with the {{Wikimedia trademark}} https://commons.wikimedia.org/wiki/Template:Wikimedia_trademark[2] and {{cc-by-sa-3.0}} https://commons.wikimedia.org/wiki/Template:Cc-by-sa-3.0[3] templates. But we don't want to replace templates on the MediaWiki https://commons.wikimedia.org/wiki/File:MediaWiki.svg[4] and the Community https://commons.wikimedia.org/wiki/File:Wikimedia_Community_Logo.svg[5] logos, which were originally released under free licenses.
There are also some pages on Commons, like this one https://commons.wikimedia.org/wiki/Commons:Licensing[6], that may need to be updated based on the re-licensed logos.

Great news! While the title of the Logo in the blogpost links to the unported version, you link to the US version of cc-by-sa 3.0 when you mention it first in the text (in the second paragraph). A mistake?

It might be simplest to change the {{Copyright by Wikimedia}} template so that it just transcludes the trademark template and the CC-BY-SA-3.0 template, e.g. by replacing its code with that at: https://commons.wikimedia.org/wiki/User:Mike_Peel/WMF A better approach, though, would be to update {{Wikimedia trademark}} to make it clear that the Wikimedia logos are CC-BY-SA, but that the rest of the file still needs to have an appropriate free license, and then to simply redirect the copyright template to the trademark template.

Practical question: The template: https://commons.wikimedia.org/wiki/Template:Wikimedia_trademark contains a line: (Consider using {{Copyright by Wikimedia https://commons.wikimedia.org/wiki/Template:Copyright_by_Wikimedia}} instead)

I'm pretty sure there is a Jimbo quote somewhere about how the Wikimedia logos would never ever be made free, and for once I am glad that he was wrong. Or maybe it was Mike Godwin. Doesn't really matter who said it, except to say that this seems like a remarkable turn around compared to the situation in the past.
Though I am curious why it took more than 9 years to get around to this. (9 years is the oldest discussion complaining about unfree WMF logos that I could dig up in less than 10 minutes of searching.)
As a practical matter it doesn't seem like any thing has changed from an external legal perspective. Is it simply that the people running the WMF today happen to feel more comfortable applying copyleft to the logos than the people running the Foundation did several years ago?

The most simple answer is: this is the nature of Wikimedia.
Same as: Wikidata was requested in 2005, in use since 2012. And so many things you can name which took multiple years.
But I think this is the nature of Wikimedia. Not in rush to compete with other parties for the first place, not in the ratrace, but walking behind on a steady distance without rushing and having a stable development of the Wikimedia movement.

I found this blog post pretty confusing. It is not obvious to me which logos we're talking about specifically. We have many logos on Commons (https://commons.wikimedia.org/wiki/Category:Copyright_by_Wikimedia has over 4,000 files in it) and while the blog post mentions "an extensive review of their copyright status," it's completely unclear to me which specific logos were part of this review. Was this a public review? Are there notes on a wiki somewhere?
My best guess is that we're only talking about the images listed here: https://www.wikimedia.org/, though this guess may be wildly inaccurate.
The blog post also includes https://commons.wikimedia.org/wiki/File:ThreeCircles.svg, but I'm honestly not sure why given that the post is about Wikimedia logos and this... isn't a Wikimedia logo, as far as I'm aware. This image's only use seems to be on a silly Meta-Wiki page: https://meta.wikimedia.org/wiki/Red,_green,_and_blue. As a long-time Wikimedian, I read this blog post and wasn't really sure what was being discussed. I have difficulty imagining that members of the general public fared much better. If the takeaway of this post was that the Wikipedia logo is now released under a free license, I think that message got lost.
Lastly, I'm curious how this blog post aligns with a file deletion that took place a week prior. "File:Wikipedia puzzle globe 3D render.zip" was deleted from wikimediafoundation.org on October 17, 2014 with the reason "Trademark - we have copies if needed". I found this deletion troubling given that I'm almost certain that this file was the subject of contentious debate for years prior to finally being published. The May 2013 upload log entries state that the files are from May 2009. The sudden unexplained deletion of a piece of Wikipedia's history leaves me concerned.

The blog post is not entirely clear as "Wikimedia logo" can have a different meaning in different contexts. Reading the blog post, I can't define precise what a "Wikimedia logo" is. "Wikimedia logo" can mean: * the logo used by Wikimedia: https://commons.wikimedia.org/wiki/File:Wikimedia-logo.svg * this logo and all the derivatives of it (for chapters, Meta, etc) * all logos of all the Wikimedia wikis, including the Wikipedia logo
The blog post speaks in plural form of logos. And the blog post is speaking about the MediaWiki and Community logos as exception, which differ much from the Wikimedia logo, I suspect that the blog post tries to say that all the logos from Wikipedia, Wikiquote, Wikisource, Wikinews, Wikibooks, Wiktionary, Wikidata, Wikispecies, Incubator, Commons, Wikivoyage, Wikiversity, Wikimania, + all screenshots of wiki pages with the logo of a Wikimedia-wiki on it, all the derivatives of these logos, including the Wikimedia family logo. https://commons.wikimedia.org/wiki/File:Wikimedia_logo_family_complete-2013....

The relicensing applies to the Wikimedia logos, which refers to all the logos of the Wikimedia wikis: https://wikimediafoundation.org/wiki/Wikimedia_trademarks. It also applies to all the derivatives that carry the {{Copyright by Wikimedia}} template on Commons. Essentially, the objective is to get rid of that last non-free license template. I'm traveling for a conference, but I will see if I can clarify the blog post on this as soon as I have better internet connection.
To address Allan's question, this does not affect the trademark status of the logos as governed by the new trademark policy: https://wikimediafoundation.org/wiki/Trademark_policy.

I don't think Erik was completely thinking about trademarks when he wrote that but I would say no, essentially nothing covered by a trademark would completely meet that definition. (and there would be major issues in my mind with not covering our major logos by trademark) Even the Creative Commons logos doesn't (for that matter I don't think the CC Logo is even under a CC License, at least not a by-sa one).

The license is clear, and wmf is an expert in these licenses . So a previous trademark is void in the respect where it restricts what is defined in the license?

I'm sorry, I don't completely understand the question but if I understand it correctly: I do in fact believe that they are experts in these licenses and do in fact know what they are doing here. However copyright law and trademark law are completely independent, you can very easily be allowed to do something under copyright law and not allowed to do it under trademark law (and vice versa) these are completely and utterly independent.
The relicensing of the logos (under copyright law) does not affect the trademark policy or any of the Wikimedia Foundation's rights under trademark law... at all. This is just like the fact that the coca-cola logo may or may not be Public Domain copyright wise does not mean that someone can make a soda, slap the coca-cola logo on it and be safe (or, in fact, sell almost anything with the coca-cola logo on it because it's so widely recognized that it would be confusing even outside of the soda sphere).
Just as an example to be clear: I don't think i've ever seen the foundation send a takedown to someone using our logos under copyright law, they were always sent because someone was abusing the trademark (pretending to be something official for example). Nothing changes about these takedowns, they are still completely enforceable and completely legitimate.
There is no doubt that the distinction between copyright and trademark law can confuse (this is one of the reasons most organizations, including Creative Commons as I said earlier, keep the copyright more restricted) especially since they often use very similar terms (license, intellectual property, registration etc) but in the end it's fairly simple: they do not affect each other. Whether something is copyrighted (or even copyrightable) is completely independent, and unrelated, to whether it is trademarked (or trademarkable).

The goal of trademark rights is to protect the logo from being used in a way that confuses the public.
