Depends on the jurisdiction, I believe - "moral rights" and all that.
Not relevant to CC-BY, as moral rights are all more restrictive than CC-BY.
I have to say the idea of having to jump hoops to "bring" PD content back
to a CC-BY restricted license sounds very very bass-ackward to me.
The key thing with moral rights is that you often can't waive them, so
they apply to everything, including both PD and CC-BY, so what you're
saying doesn't make sense. Moral rights can't be more restrictive than
CC-BY, since they apply to CC-BY just as with any other license.
