I presume that this is an image of the flag to which Jason & Mako are refering:

That image is CC-BY-SA-2.5,2.0,1.0. So if we take the image of the tree, I believe we would need to acknowledge Alexander Baretich. However, if we take it as inspiration & create somewhat different version of a conifer, well, that's a different matter.

I don't mind the off centered circle but I had the same thought
about the tree. The flag tree is also a bit more iconic as opposed to
representational (i.e., one color) which I think makes it look a
little bit better as a logo.
