I participated in organizing some competitions "scaled" (or level organizated) ,much more modest but with  the same purpose: increase the interest and participation.
In these contests is often used the formula to select finalist works  by the "local" jury and, of course, the local winners. The local organization then sends all the finalists works (awarded or not) at "general" competition and the "general" jury will select the winners among all the "local" finalists. This presents advantages in terms of participants: If your work is finalist it colud be awared localy or general, or both, or none.
The photography is an art and therefore has a touch of subjectivity that is given by the people of the jury. Is normal in such competitions That win a work that has not been awarded locally.

I think that case would not be so problematic, in my opinion (the 1st place is the "real" winner). But like you say, the criteria used can be different, and if we make that clear from the beginning, in the rules, etc., people will have to accept that there would be, in fact, 2 different competitions, with different results.

Would the third ending up higher than the second be a problem too, then? 

(to be clear: I wouldn't have a problem with either situation, since like Nuno says, there are many factors. Even the exact criteria used by the jury will differ on European level compared to for example the Portuguese jury).

The 2nd of a country ending up higher than the 1st in the European Competition is in fact a problem. Maybe there could be 2 different groups. Maybe the european jury could decide between the 1st ones from each country (resulting in a overall winner - for each category), and they could also decide between the rest (2nd and 5th place in each category, for example).
