私のほうは 4月の件の　drafting に手を付け出したところです。現在百楽天さんと 交渉しておられるということでしたら、先ほどMLにいただいたご報告をもとに、そちらを まとめていただけないでしょうか。

厳密には ja.wp 上ではありませんが、訴訟予告とも取れる内容の投稿が氏の名義で なされていますので、一応報告しておくべきではないかと思いました。削除に関わる wikipedia 側の責任という観点からも注目に値する案件かと思いますので。

■ General Background

This year we have now no legal issues or troubles on any other Japanese projects than Wikipedia (except Wiktionary deletion issue on June, see the below #Legal issues related to ja in 2004).

Situation on ja.wp has not changed from Tomos report on May (User:Tomos/Legal_discussions_on_Japanese_Wikipedia) basically. On processing deletion and blocking/banning the basis of juristic analysis are same, but recently the growth of users has reflected to the current situation. Here I point out some changes.

Decision on deletion and blocking/banning were formerly on full concensus, but now are based on rough consensus. Today it is difficult for ja.wp to reach the full consensus because of its huge population of registered users, although most of decision are made based on full consensus in fact and the request for cancellation of decision are rare in case there were opposite parties.

Certain contributers assert the deletion should be (or is expected to) noticed to the original contributors, in addition to thier agreement in advance at the time their submission. This opinion is partly based on a view of courtesy but also on the legal aspect in relation to a Japanese law, Law of Providers' Responsibility or shortly ISP Law(see the below, #Deletion and ISP Law).

Introduction of ''Terms of Use" which will be applied only to Japanese Wikipedia was proposed in February 2004, when there was no other Japanese project within Wikimedia. The proposed draft of Terms of Use was written in Japanese and discussed during February and March mainly. But the discussion is ceised after then it is still a draft. That draft is linked from MediaWiki:Lastupdate but seldom refered in the community. There is no possibility of further discussion on Terms of Use now. Other Japanese projects have no such discussion on making their own Terms of Use or shared with other projects.

(Aphaia) ■ Deletion and ISP Law

On ja every contributor is expected to read the notices below the edit window including they are consider to give the project full agreement for the possible deletion of their contribution whenever they submit. On the other hand in Japan, Law Concerning Limitation of Damages to Specific Telecommunications Service Provider and Disclosure of Sender Information, so-called ISP Law states that each deletion by the provider against the will of the user who submitted the content is relieved of their resposnsibilities of any compensation for the user concerned with notice 7 days before the deletion, if the deletion is requested by a third party because of legal violation (e.g. copyright). It has been argued if such notice to a certain user is necessary or not, specially the users themselves disagree with the deletion of their submission. In particular this argument has arisen in case users complaint such deletion has no appropriate reason and violates therefore their own right (freedom of expression?) or honor. Also there is no strict correspondence between Common Law juristical terms/concept and Japanese one reflecting diffenrences of their legal system. The terms in Japanese Law might be roughtly translated here, it could cause inacuracy and misleading too.

(1) If process of a particilar blocking was unfair. (2) If deletion of certain pages were done through unfair process and/or wrong reason. (3) If postings on Village Pump BBS are defamatory in nature.

Note: Peculiar nature of the dispute is that the legal part of the dispute is not strictly related to the Wikimedia Foundation or Wikipedia administrators. It is whether some of the anonymous or quasi-anonymous postings on a BBS that is argued to be defamatory against a Wikipedian.

X, now a blocked user for an unspecified time period, started posting (under the account name) since around March, 2004. From earlier on, some pointed out potential copyright infringements in his contributions. X accepted some, rejected others, and showed unclear responses on yet others (details below).

Over time, increasing number of his contributions were found to be potential copyright violations, containing similar texts with external web sites. According to one user's count on early October, X made contributions to more than 160 articles excluding those marked as Minor and redirects, and 45 of them had already been deleted, and another 38 were questioned because of alleged similarity with external web sites.

Regarding some of these articles, X argued that there were some factual errors in the external web sites, and his writings were free of those erros. This type of remarks is an indication of X's knowledge, and the fact that he did not merely copy the said external site. Yet it is unclear if he thinks it is also an evidence that he did not base his contributions at all on those pages. It is also sometimes unclear what are the possible explanations to the similarity, that were sometimes hard to believe to have happened by chance (a third source common to both X's writing and an external site may be a possibility).

X was blocked in Mid-august because he changed others' remark in a discussion (this is considered a legitimate reason for immediate, temporary blocking at Japanese Wikipedia).

The change he made to another's writing was not very clearly in favor of X's position, and many regarded that it might be an error. Yet X indicated, in a discussion on the BBS following the block, that it might have been caused by a cracker, a mal-intended Wikipedia administrator, or a bug. Until prompted by another later, he did not suggest that it was his honest mistake. And that deterred the unblocking.

Until early September, Wikipedians argued for and against blocking, extention of the block and unblocking. The concerns raised include the number of articles under copyright-related investigation, X's mixed attitude in discussions (some observed that he was improving and became more cooperative), if the uncooperativeness was a clear enough reason for a block.

Major arguments made by X and other mostly non-wikipedians who argues for X include: a) Certain users are targeting X by requesting deletion of his contributions. b) Certain pages are deleted without full discussion of legal risks (or the lack thereof). c) Certain pages are deleted for wrong reasons, such as citing a wrong source as the original work from which the X's contribution was allegedly made in a legally problematic way. d) The BBS is not a hospitable environment for discussion due to many defamatory and otherwise offensive or unfriendly remarks against X. e) The way notices were placed and deletion requests were made present X as if he is a criminal. It is a false, defamatory or offensive representation of X. f) Blocking of X was requested by user Y as a retaliation to the X's deletion request on Y's.

Wikipedians and some others often argue, not unanimously, that: a) X respond to the questions selectively, avoiding to admit his mistakes and/or wrongdoings. (To his credit, X do admit some mistakes and probable copyright violations.) b) More specifically, X on multiple occasions made claims that he knows where an external web site is wrong, when presented with a site that contains a very similar or same text as X's contribution. This is only indirectly a relevant information in deciding whether the X's contribution violates copyrights of the rightholder(s) of the said external web site. This problem is pointed out to him by multiple people in multiple contexts. c) X sometimes writes in length in those discussions about possibilities of copyright violation , but substantial amout of his postings were unrelated to the issue, cluttering the discussion.

d) X may have repeatedly violated copyrights of others, in spite of repeated notices and warnings since at least early April. Whether it is a fully intentional violation is unclear, due partly to the fact that X has research memos that he bases his contributions on. The memos may contain problematic pieces of texts to publicize, and X may not be fully aware of which parts are problematic. e) There are new users appering to argue in his favor in many occasions. Some suspect that some of them are his sock puppets or acquintances of X. (X admitted that some were his sock puppets and friends.)

Future Prospects:

今後の展開に影響を与える可能性がある幾つかのファクターがある。

There are several factors that may shape the future development of this matter.

a) BBS上での議論は継続中だが、実を結ぶかどうかについては悲観的な見方をしている人もいると思われる。 b) Xの実質的な投稿・加筆があった全ての記事を削除することが最近提案された。Xは以前そのような削除に同意したことがあったように見え、また、他の多くのウィキペディアンは c) その案に賛成したので、実施される可能性が高い。 d) Tomosは9月初旬よりメールで対話を試み、可能な解決策を模索している。これについて更に知りたい場合には、連絡を希望する。 e) Xはウィキペディアの管理・運営の実態についてメディアで書く可能性を示唆している。

a) Discussions on BBS is ongoing, although some may be pessimistic about the fruitfulness of the effort. b) Deletion of all articles that received substantial contribution from X was suggested lately. c) X seems to have agreed with such a deletion in one context before, and many other wikipedians agreed with the idea, making it likely to be acted upon. d) Tomos is communicating with X since the early September, exploring the available options to resolve those disputes. Contact him if further information is needed. e) X indicated that he may write about poor state of Wikipedia administration on media.

今回の件は、削除そのものよりも、削除依頼と削除の基準、投稿ブロック依頼とブロックの基準 に、私は大きな疑問を持っています。 とくに、このBBSにおける執拗なまでの攻撃は我慢の限界を超えました。

Personaさんのリストも含め、何らの謝罪もなく削除が実行されるのであれば、法的なことも 考慮した上で、思案中の３つの処置のうち、どれかを実行したいと思っています。

誰に何を要求しているのか、処置とは何なのかは不明ですが、削除もブロックも ja.wp の 運営に関わることで、井戸端BBS の管理人である Hoge-氏が念頭に置かれているとは 考えがたい気がしました。

このように運営をめぐって、なにやら「処置」が思料されているということであれば、具体的に 何が考えられているか・また財団が念頭におかれているかは不明とした上で、訴訟リスクに ついて、事態の新展開によるレポートの追加を検討したほうがよいのではないかと思います。
