As a more general note/context, everyone working in this area should be aware of a few key points:
your intuitions about copyright may/may not apply, so be careful :/
copyright law has had 100 years, multiple international treaties, and thousands of cases to be refined; database law has 15 years, no international treaties, and a few dozen cases. So clear yes/no answers are going to be hard to come by :/
