Hi all
Today WIPO celebrates World Intellectual Property Day http://www.wipo.int/ip-outreach/en/ipday/ and I just wanted to bring to your attention a campaign by Communia, Kennisland, and Centrum Cyfrowe: the three organizations have been looking into the copyright status of Anne Frank's diary in Europe. It turns out that the original Dutch version is in the public domain in Poland -- but not in the Netherlands.
Find more info about the #readannediary campaign that calls for shorter, harmonized copyright terms here http://www.communia-association.org/2016/04/25/anne-frank-term-copyright-protection-time-move-harmonisation-unification/ .

Hi Jan,
yes, this topic also had a lot of attention from Wikimedia Nederland before (Although I believe we're not involved with this particular project). I cc'd Sandra and Jos who are more involved with it.

Sympa, surely from Poland. But are the really unaware that the Dutch text is available online, from Canada? http://wikilivres.ca/wiki/Het_Achterhuis_(Anne_Frank)
They could have also spent some money on a new Polish translation, to be brought online in the public domain.
best,
Jos

Hi Jan,
Re. your statement: "It turns out that the original Dutch version is in the public domain in Poland -- but not in the Netherlands"
This may be premature. It all depends on whether you accept the claim that Otto Frank has copyright over Anne Frank’s diary. As I stated on the communia-blog http://www.communia-association.org/2016/04/25/anne-frank-term-copyright-protection-time-move-harmonisation-unification/: that claim has not yet been upheld by any court and is considered invalid by several experts on the writings of Anne Frank.
I am not sure whether this campaign - however sympathetic its cause - helps ensure that Anne Frank's diary remains firmly in the public domain, as it appears to take these claims for granted,
Also: the text of the diary has been available from this (French?) website http://affordance.typepad.com//mon_weblog/2016/01/anne-frank.htmlsince January 1.

Hi Sandra
Thanks for pointing this out! And you are right, of course. That statement is debatable.
The campaign is not ours and I don't necessarily agree with all of it. But I think your message actually proves one important point that the campaign tries to make: without harmonized copyright European citizens are uncertain about what they can or cannot use.
And that's what is problematic from a perspective of free knowledge and online collaboration. That's why I shared the link to the campaign on this list. I am happy you are weighing in on this important topic.
Best, Jan

Hi everyone,
First, I want to introduce myself, as I’ve been a lurker until now on this list. My name is Alek Tarkowski, I head a Polish digital / open think tank called Centrum Cyfrowe, and I’m also active with Communia. The campaign that you are discussing has been created by us, and I’m happy and open to discuss it. Please feel free to share any doubts, criticisms or suggestions.
Regarding the copyright duration, please note, that this is not just an issue of Otto Frank’s co-authorship. There’s also the issue of extended copyright protection for works published post-mortem. Because of this, versions A and B of the diary, despite having not been edited by Otto Frank, are according to Dutch law in copyright until 2036. We’ve written about this on our blog: http://www.communia-association.org/2016/04/25/anne-frank-term-copyright-pro... http://www.communia-association.org/2016/04/25/anne-frank-term-copyright-protection-time-move-harmonisation-unification/
We were not aware that the diary has been already made available, thank you for providing the link. I still feel that the advantage of our work is the effort we put into making this case public.
All the best,
Alek Tarkowski

This version of Wikilivres came original from the Dutch Wikisource, where WMF had to delete it: https://blog.wikimedia.org/2016/02/10/anne-frank-diary-removal/ Result of the disadvantage of having servers of Wikipedia/Wikisource in the US.
Yes, the original texts of the diary are PD.
