First I'd argue the use is de minimis, but that might fail...

I have no doubt that the usage would pass the
fair use tests. It would
be more interesting to look at this in terms of the right of
attribution. This fits more correctly into the package of moral rights
that Europeans care so much about. Nokia is, after all, a European company.
