IANAL, but as I understand it the lower-level courts based their decision<br>
on certain laws, and the Constitutional Court was asked to say whether that<br>
is unconstitutional due to freedom of speech, and they said it was not;<br>
they did not say the responsibility of content providers follows directly<br>
from the constitution. So if the laws in question (2001/CVIII e-commerce<br>
act + civil code) are changed, that could affect the situation. (And of<br>
course the constitution could be changed - the current ruling party has<br>
supermajority and does that quite frequently.)<br>
<br>
Given that the current government has so far always changed laws towards<br>
less freedom of speech, not more, I wouldn't hold my breath, though.<br>

Neelie Kores, outgoing Commissioner for the Digital Agenda held a speech at<br>
a conference in Amsterdam yesterday where she spoke about the need of the<br>
planned copyright reform. [1] Among other things, she said:<br>

*When you can't sing happy birthday, or post a picture of the Atomium, how<br>
is that fair or reasonable, how is that something you can explain to<br>
ordinary citizens?*<br>

Yes, it is an outgoing Commissioner and DG CONNECT is the not the lead DG<br>
for copyright, but this is the first time the European Commission said<br>
anything about Freedom of Panorama. I know for a fact that it was the<br>
members of the Free Knowledge Advocacy Group EU and their constant talk to<br>
anyone about this issue how the Atomium example showed up on the radars of<br>
both DG CONNECT and DG MARKT. In this line of thought I just wanted to say:<br>

This is absolutely brilliant, Stevie! Romaine's image and the text you<br>
added next to it. Plus the story we have to tell with the EP Secretariat<br>
giving us permission to use it on Wikipedia only to figure out later that<br>
they don't the rights and thus can't allow us to use an image of their own<br>
building.<br>
<br>
Could WMUK or another chapter print this image with the text on a banner?<br>
180x76cm would be enought. We could use it at events around Brussels to<br>
raise awareness in a very powerful way. I could even imagine an info-booth<br>
inside the Parliament.<br>
