If it's of the person, and it is used in an article about the person,
and it's a photo that is especially illustrative of the person, you can
claim fair use, but *only for the article about the person*. Or at least
that's my interpretation of how it works.
Under Chrissy Hynde's entry someone used a scan
from the Pretender's
Greatest Hits cover. Acceptable? I'd hate to see it be
deleted...but I'm also trying to figure out if photos like that are
acceptable.
The cover would probably be more suitable for an article about the album
or the band than a member of it.
& I know one of my favorite actors has a page with
a non fair use
photo. Because it came from newspapers and magazines. They didn't
take it. I don't want to rat them out. :)
Put it on IFD then.
I just mentioned Hynde's entry because I want to
know if a CD cover
scan is acceptable? And I had to mention the picture so you guys
could see it. :)
Make sure that a claim of fair use applies. It is believed that under US
law, an album cover is fair use if it is used to illustrate an article
about the album/band.
BTW, have you considered subscribing to the English Wikipedia mailing
list? You can do so at
<http://mail.wikipedia.org/mailman/listinfo/wikien-l> or
<mailto:wikien-l-request@Wikipedia.org?subject=subscribe> - a lot of
discussion about Fair Use takes place on the English Wikipedia list,
because that is one of the few Wikipedias which allows Fair Use images
(if not the only one).
